It is not only important but extremely urgent to have the International
Court of Justice order an immediate halt to the ongoing genocide perpetrated in Gaza by Israel.
We fully support South Africa’s submission to the International Court of Justice which sets out a that “acts and omissions by Israel … are genocidal in character” as they are committed with the intent “to destroy Palestinians in Gaza” as a part of the broader Palestinian national, racial and ethnic group.
We are aware and have repeatedly warned about the brutality of war crimes committed by the settler colonial regime.
Now that South Africa has lodged this case, we are confident that it provides an important opportunity for the International Court of Justice to scrutinize Israel’s actions in Gaza using the Genocide Convention of 1948.
We are certain that international crimes, such as crimes against humanity and war crimes, that are brazenly being committed with impunity, does meet the threshold of genocide or related crimes as defined in the 1948 Convention on the Prevention and Punishment of Genocide.
Though South Africa had previously filed a referral to the International Criminal Court (ICC) for an investigation into alleged war crimes committed by Israel in Gaza, the current application to the ICJ, as the highest judicial body of the United Nations, displays serious commitment by SA to secure justice for Palestine.
